Subscribing customers: if your organisation has a signed agreement with us for Vantage, that agreement governs your use of the platform. These terms cover the public website and demonstration access only. If the two conflict, your agreement wins.

01About these terms

These terms apply when you browse the Vantage website, submit a demo request or sign in to a demonstration environment. By using the website you accept them. If you don't agree, please don't use the website.

If you use the website on behalf of an organisation, you confirm you have authority to accept these terms for it.

02Who we are

The website and Vantage are operated by Difiza Pty Ltd (ACN 629 454 164), headquartered at 490 Northbourne Avenue, Dickson ACT 2602, Australia ("Difiza", "we", "us"). You can reach us at [email protected].

03Using the website

The website is provided for information about Vantage and so you can contact us. We may change, suspend or withdraw any part of it at any time without notice. We aim to keep it available, but we don't guarantee it will always be available or free of errors.

The information on the website is general. It describes the product's capabilities and is not an offer. The features, availability and pricing of any subscription are confirmed only in a written agreement.

04Demonstration access

We may give you sign-in details for a demonstration environment so you can evaluate Vantage. If we do:

  • Access is personal to you and your organisation, for evaluation only, and can be withdrawn by us at any time.
  • Keep your sign-in details confidential and tell us straight away if you think someone else has used them.
  • Demo environments may be reset at any time. Don't enter real, confidential or personal data. Anything you type may be deleted without notice.
  • The demonstration is provided "as is", free of charge, without any service levels.

05Acceptable use

You must not:

  • use the website or demo in a way that breaks any law, or for any fraudulent or harmful purpose;
  • try to gain unauthorised access to the website, its servers or any connected system, or test their security without our written permission (see our responsible disclosure process);
  • interfere with or disrupt the website, for example by overloading it, sending automated requests or spam through our forms, or introducing malware;
  • scrape, copy or harvest content or data from the website by automated means;
  • reverse engineer, decompile or copy any part of Vantage, or use the demo to build a competing product;
  • misrepresent your identity or your organisation when requesting a demo.

06Simulated content

Vantage creates fictional scenarios for training. This includes simulated emails, news stories, social media posts, calls and documents. Any resemblance to real people, organisations, places or events is unintended or used for illustration only.

Simulated content is not real information or advice. Don't rely on it outside the exercise, and don't present it as real.

07Intellectual property

The website, Vantage and all their content, design, software, scenarios and trade marks belong to Difiza or its licensors and are protected by intellectual property laws.

You may view the website and print or download extracts for your own internal evaluation of Vantage. You may not otherwise copy, modify, distribute or commercially use any of it without our written permission.

08Feedback

If you send us ideas or feedback about Vantage, we may use them to improve our products without any obligation to you. We won't identify you publicly without your permission.

10Disclaimers

Australian Consumer Law: nothing in these terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Subject to that, the website and any demonstration access are provided "as is" and "as available". To the extent the law allows, we exclude all other warranties, conditions and terms that would otherwise be implied, including as to quality, fitness for purpose and accuracy.

Exercises run in Vantage help organisations prepare. They don't guarantee any particular result in a real incident, and they don't replace professional, legal or emergency advice.

11Limitation of liability

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including under the Australian Consumer Law.

Where the Australian Consumer Law lets us limit our liability for failing to meet a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Subject to that, and to the extent the law allows:

  • we are not liable for any loss of profits, revenue, business, goodwill, data or anticipated savings, or for any indirect or consequential loss, arising from your use of the website or a demonstration environment; and
  • because the website and demo are provided free of charge, our total liability to you in connection with them is limited to AUD $100.

12Suspension

We may suspend or end your access to the website or a demo at any time, in particular if we reasonably believe you have broken these terms.

13Changes to these terms

We may update these terms from time to time. The date at the top shows the latest version, and continuing to use the website means you accept it. Please check this page now and then.

14Governing law and disputes

These terms, and any dispute arising from them or from your use of the website, are governed by the law of the Australian Capital Territory, Australia. You and we submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and the courts that hear appeals from them.

If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a right straight away, we can still enforce it later.
